GENERAL CONDITIONS OF SALE

1. - DEFINITIONS

1.1 The general conditions of Sales (hereafter referred to as "General Conditions") detailed below only govern the contractual relationship between the Consumer and the trader www.arredatutto.it belonging to the company D2A Servizi S.r.l. (hereafter referred to as “D2A”) registered office at Via Vespri Siciliani, 38 - 20146 Milano, Italy, equity capital of Euros 10.000, listed on the Milan company register No.1852152.

1.2 Both parties accept these General Conditions unreservedly.
These General Conditions are the only conditions that are applicable and replace all other conditions, except in the case of express, written prior dispensation.

1.3 D2A can bring unilaterally and in every times adjustments to these General Conditions by notices published on the Net. On this way, D2A will provide to inform the Consumer about every modifications by messages in its site pages, in such way that the Consumer can know it before he progress to the purchase.

2. - THE CONTRACT'S CONCLUSION

2.1 The contract drew up between the Consumer and D2A is considered improved and produces effects only with the acceptance of the purchase's proposal (Ie the order "in progress") by D2A, which reserves the right, to its unchallengeable judgment, to accept or reject the order previous check on the availability of the product object if it is satisfied about the availability of the product under the conditions set forth in the proposal itself.
Acceptance of order is to move the same status from "Waiting" to "in process".
In case of rejection, D2A promptly notifies the Consumer by e-mail or phone and the grounds. explaining the causes.

2.2 The proposed sale includes "except while supplies last. Where the actual product is no longer available from suppliers and/or it was in times longer than those listed on the site (in the product data sheet under "average delivery time"), will be at pains to warn D2A promptly the Consumer by mail or telephone.

1)change the product;

2.3 By making the order, the client automatically declares to have read all the information provided during the purchase procedure and accept the Terms and payment transcribed below. This also applies to orders placed by phone or email.

3. - PURCHASING

3.1 Consumers may only purchase products which are viewable in the electronic catalog of D2A Servizi at the time when the order proposal is placed - products that are published on www.arredatutto.it at that moment, as described in the relevant information sheets.
The technical information included in the site www.arredatutto.it faithfully reproduce the original published by manufacturers in their paper catalogues or public websites.
D2A Servizi reserves the right to update the technical information or pictures of products, to match those provided by the manufacturers without further notice.
Please note that the picture of a product may not be fully representative of its characteristics: the product may differ in color, size, accessories shown in the picture setting. D2A Serivzi is not responsible for any errors or technical inaccuracies in the photos or descriptions, due to mistakes on the website or printed catalog of the manufacturer. Before ordering, if Consumers are interested in specific characteristics of a product, they are required to contact the manufacturer, to ensure that the product meets their requirements, or to choose a product, that does. No responsibility is held by D2A for inaccuracies or inconsistencies in the statements or pictures published by manufacturers.

3.2 The correct receipt of the Order proposal will be confirmed by D2A Servizi by e-mail, sent to the address supplied by the Consumer upon registration.
This order confirmation message reports Date and time of the order proposal and an 'Order Number', to be used in any further communication with D2A Servizi. The message also reports all data entered by the Consumer, who must now verify that all data is correct and communicate any inaccuracies to D2A Servizi.
Consumers can check the status of their orders from the website www.arredatutto.it, logging in and opening the section called "My Account".

3.3 Cancellation of orders by Consumers is always possible when the order proposal has not yet been accepted (ie, the order is still "Pending").
The order status is clearly visible in the "Your Account" website area. By no means an order is voidable if the indicated status is "in shipment".
If an order's status is "processing", Consumers may asask for authorization to cancel their order.
If cancellation is possible, D2A Servizi will keep 3% to 10% of what the Consumer already paid to cover administrative and operational costs (the exact amount will be communicated to the Consumer before the cancellation).
If it is impossible to cancel the order, Consumers can use the Right of Return, as the following paragraph 10.

3.4 After receiving an order Proposal, D2A will conduct an audit for acceptance, as previous art.2.
In case of rejection of the Proposal, D2A agrees to give prompt notice to Consumer.

3.5 All prices on this site are intended retail price, and include VAT.
D2A reserves the right to change prices at any time without notice.

3.6 Simultaneous access of many users and the simultaneous ability to order on-line could change the availability of the product or its price.
For this reason, if at the time of Order Proposal any changes become necessary, D2A will send an email to the Consumer and communicate all changes to products availability or price, that have been necessary. This communication makes a new proposal of selling, overriding the order proposal made by the Consumer.
If the Consumer does not accept the new sale proposal, the order will be canceled.
Is excluded any right of the Consumer to ask for damages compensation in this event.

3.7 For each order placed on www.arredatutto.it, D2A Servizi will issue an invoice for its issue, will prevail on the information provided by the Consumer when ordering. No change in the bill will be possible after the issuance thereof .

4. - PAYMENT

4.1 Payment of the price of products, services and any shipping charges will be made on delivery, credit card, bank transfer, online payment services, PayPal or installment financing provided by Agos SpA

4.2 If paying on delivery, an additional fee of 3% (with a minimum of 15 Euro) is applied to the total amount of the order. It is clearly shown in the choices of payment methods during the order.
You are asked to make a deposit via bank transfer of the 50% of the total amount, the remaining 50% will be paid directly at the delivery.
Payment must be made to the carrier by BANK DRAFT payable to D2A SERVIZI SRL or cash (for orders below 1.000 €).
The deposit and the balance due, are clearly indicated on the site, in the order pages.

The method of payment on delivery is only available in Italy.

4.3 In cases of acquisition of goods with payment via Credit Card, together with the completion of online transaction, the bank reference shall authorize only the amount of the purchase commitment.
The amount of the goods processed automatically charged to your credit card the Consumer when the order proposals.
Credit cards accepted are all those who support the Visa, Mastercard and Debit Pago;  
In case of cancellation of the order (whether this is actually by the Consumer or in the case of rejection of the purchase), D2A require the cancellation of the transaction and release the amount committed.

The timing of release for certain types of cards, are solely dependent on the banking system. The annulment of the transaction, D2A in no case be liable for any damages, direct or indirect, caused by delay in release of non-commitment by the banking system.D2A reserves the right to call the Consumer information (eg. Landline telephone number) or sending copies of documents proving the ownership of the paper used. In the absence of the required documents, D2A reserves the right not to accept the order.
At no time during checkout D2A is able to know information about the buyer's credit card, as they are typed directly at the bank handling the transaction (with very high security systems), since there are no transmission data, there is the possibility that this data is intercepted. No archive of D2A contains or maintains such data. In no case, therefore, D2A be liable for any fraudulent and unfair credit card by a third party, on payment of products purchased on www.arredatutto.it

The cancellation order by the Consumer is possible until the time when one has not yet been accepted. The order status is clearly visible in the "Your Account":an order is not voidable if the indication "in shipment". If a product is in status "Processing" is voidable permission. In this case D2A will keep from 3% to 10% of the amount paid by the Consumer for administrative and operational costs (the exact amount will be communicated to the Consumer before the cancellation).
If the cancellation of the order is no longer possible, the Consumer can then use the Return Policy, as follows punto.10.

4.4 In case of payment by bank transfer in advance, the products ordered by Consumer are kept busy until receipt of proof of payment. Consumer may provide such evidence by fax to +39 02 92878721 or e-mail to payment@arredatutto.it
The sending or delivering what the Consumer is only ordered after the effective crediting a/c of D2A amount due. The transfer must be ordered by the Consumer within 5 working days from the date of acceptance, after a period where the order is deemed automatically canceled.
The purpose of the bankmust state the order number given in the e-mail order confirmation.

4.5 In case of purchase with prepaid credit card, the Consumer inserts the card identification numbers, together with the completion of online transaction, the bank reference shall authorize only the commitment of your purchase.
The amount of your purchase is automatically charged to your credit card the Consumer when ordering.
In case of cancellation of the order (whether this is actually by the Consumer or in the case of rejection of the purchase), D2A require the cancellation of the transaction and release the amount committed.

4.6 The on-line transactions by credit card are made directly on the site of the Bank, through a secure server adopting the security system SSL (Secure Socket Layer). This protocol, VeriSign certificateAllows you to communicate in a way designed to prevent the interception, alteration or falsification of information.
D2A is never aware of the details of credit cards used by its Consumers.

4.7 In case of purchase through the PayPal payment method at the end of the order the Consumer is directed to the PayPal login page.
The amount of the order is debited from your PayPal account at time of order.
In case of cancellation of orders, from both the Consumer and in case of rejection of D2A, the amount will be refunded the Consumer's PayPal account.
The annulment of the transaction, in no event D2A Services can be held liable for any damages, direct or indirect, caused by delay in release of non-committed by PayPal.
At no time during checkout D2A Services is able to ascertain the financial information of the Consumer.As there is no data, there is the possibility that this data is intercepted. No archive of D2A Services contains or maintains such data. For every transaction made with your PayPal account you will receive a confirmation email from PayPal.

4.8 By choosing the installment payment (Italy only), the Consumer will be transferred for completion of the order on the website of Agos SpA, where you can choose the type of rescheduling. Having read the terms of financing and related interest rates are then applied to the Consumer personal data.
The granting of financing and completion of the order are subject to prior approval by Agos. The transaction is always in protected mode on the website of Agos, with 128bit encryption to ensure the appropriate level of confidentiality of information sent. Data is provided directly and exclusively to Agos and for any reason will be made available to D2A.

5. - DELIVERY TIMES

5.1 The average delivery times indicated on the descriptions of the products in the "Average delivery times are for guidance only, they can vary due to force majeure independent from the seller.
The standard delivery unless otherwise agreed in writing between the parties, will take place at the following times: from 9.00 to 13.00 and from 14.00 to 18.00 every day except holidays, from Monday to Friday.

5.2 D2A agrees to make delivery as soon as possible and in any event within 30 (thirty) working days from the day following that on which the order was passed "in process". If it proves impossible to meet the deadline, the order will be canceled and the Consumer any amount paid will be refunded.
No responsibility can be attributed to D2A in the event of delay in the order or delivery of goods ordered for the effective delivery at ns. stores could be extended without notice due to external events. D2A and its suppliers, therefore, are not liable for any delays than expected arrival indicated.

5.3 D2A inform the Consumer by sending an e-mail, the date on which the package was delivered to the carrier (where the goods are delivered by courier within the meaning of art. 6.1).

5.4 Where delivery is made by courier under Article. 6.1, at the end of the terms set out in paragraphs 5.1 and 5.2 of this Article, the obligation to deliver the product at the end of D2A is considered regularly fulfilled when your order is delivered to the carrier.
Any delay and/or a disruption in delivery of the package must be attributed solely to the company that handles shipping.
In such cases, the Consumer undertakes not to make any compensation in respect of D2A.

6. - DELIVERY OF GOODS

6.1 The product ordered will be delivered to the Consumer by courier or in areas where such service is active, direct from D2A. The delivery of goods can take place or number, or limited only to appliances, floor residential Consumer. For this second type of delivery will be applied to the cost of shipping a premium price, clearly demonstrated in the choice of delivery method. For stoves and fireplaces, if the carrier so requires, may be necessary to add an additional surcharge, which will be previously communicated to the Consumer for acceptance.

6.2 D2A (areas covered by the service) to deliver the appointment, the Consumer will then be contacted by phone to secure the delivery date and time slot. In areas served by courier delivery will instead take place without an appointment. The courier will send an email to Consumer, stating the day of delivery.In the absence of the Consumer, the courier will leave a notice asking to be contacted to arrange an appointment for delivery. In case of further absence of the Consumer, any charge levied by courier will be charged to the Consumer. If the Consumer does not render it more available, the goods will be made to D2A, resulting in cancellation of the order and nothing will ever be due to the Consumer.
Transport costs will still be charged to the Consumer.

6.3 The delivery by the courier, in the absence of the Consumer first attempt at delivery will be within 3 working days of telephone contact.

7. - INSTALLATION OF THE PRODUCT - WITHDRAWAL OF LARGE APPLIANCES

7.1 The installation of large appliances and furniture purchased www.arredatutto.it shall be conducted only in some areas specifically listed on the site, upon payment of a fee of a price to be clearly informed when the request.

7.2In the same areas, for certain types of products may be put in the service of collection of used, must be contextual to the delivery of new product, which we will follow appropriate disposal in compliance with the regulations on transport and environmental protection.

8. - COMPLAINTS

8.1 Upon delivery of the goods, the Consumer is required to inspect:
• the number of packages delivered corresponds to what is stated in the invoice;
• the packaging is not damaged or wet or otherwise altered.

8.2 Any external damage or the mismatch in the number of packages or particulars, must be immediately reported to the courier who delivers, adding the word "STOCK CONTROL GOODS" on the appropriate document and confirmed within 8 days by registered mail with return receipt to the courier, the address of which is explained on the accompanying document.

8.3 In caseof damaged package to write "subject to removal because the package is damaged." Once signed the document courier, the Consumer will not oppose any dispute about the appearance of what was delivered.

WARNING: IF YOU AGREE WITH NO RESERVES REQUIRED TO APPEAR THE GOODS DELIVERED BY COURIER, MAY NOT BE IN NO WAY CLAIM any shortages or damaged during transit.

Also specify that the words "neck integration acceptable subject to control" or similar will not be considered by the courier then does not accept claims or damages, so the test must be done on time with the courier.

8.4 Any hidden defects (eg, theft, missing, damaged in transit) must be reported in writing by registered mail with return receipt to the Carrier whose address is explained on the accompanying document, within 8 working days from delivery.

In any case D2A undertakes, without accountability, to also send the same signal to the carrier.

8.5 If delivery is made directly from D2A, with its resources and personnel in the areas covered by this service, all reports will obviously not be sent to D2A itself (using the form at http://www.arredatutto.it/en/returns.html ). Since D2A will have the responsability of transport within 8 working days from delivery.

Each alert over these terms will not be taken into account.
For each statement, the Consumer assumes full responsibility for the statements.

9. - GUARANTEE

9.1 The D2A -through of your organization and in the manner set out below, ensures the smooth functioning and free from defects in manufacture for private labels D2A Servizi srl marketed by third parties during the warranty period stated in the next p.9.4 of these "conditions".

9.2 In the event of malfunction or manufacturing defect of the product D2A will, through its organization qualified engineer or the manufacturer, repair and if this is not possible to replace the product.

9.3 In the event of malfunction or manufacturing defect, the Consumer must send the request for assistance via the web site refer to the "Technical Support", or contact the Call Center number +39 02 42292871 (Italian and English only) that will verify and award of ' intervention, if any, by courier will operate the collection of faulty product, or sending technician for the service required;in case of withdrawal by courier service users pay on delivery the only shipping charges for returning the product in case of delivery service, users pay only the costs of the call fees applied by the manufacturer of product;

09.04 D2A Servizi srl provides the warranty under the terms of DL 185/99, legislative decree 24/02 and subsequent amendments.

9.5 No warranty parts subject to wear, the aesthetic parts, products with seal damaged and/or tampered with, and damage caused by accident, negligence, misuse, unauthorized use of parts, improper packaging, , or any other cause not attributable to defective product D2A Servizi srl

9.6 Excluded from this Warranty:

a) Periodic maintenance and repair or replacement of parts due to wear and tear;

b) consumables (components that likely require periodic replacement during the useful life of a product, for example, dry batteries, light bulbs, etc.).

c) damage or failure due to use, operation or improper handling of the product for purposes other than normal personal or domestic use;

d) damage or modify the product resulting from misuse, including:

  • treatments causing damage or alter the physical, aesthetic or superficial damage to the product or liquid crystal display;
  • Incorrect installation or use of the product for purposes other than those provided or failure to manufacturer's instructions on installing and use;
  • Improper maintenance of the product, not in accordance with the manufacturer's instructions on proper maintenance
  • installation or use of the product does not meet the standards or safety in the country where the product is installed or used;

e) conditions or defects in the systems to which the product is connected or in which it is embedded.

f) repair or attempted repair by unauthorized personnel and service center not authorized;

g) alterations or modifications made to the product without prior written consent of D2A Servizi srl, including:

  • excess product update the specifications and functions described in the manual or product changes to conform to safety standards or national or local in countries other than those for which the product is specifically designed and built;

h) negligence;

i) accident, fire, liquids, chemicals or other, water, vibration, excessive heat, inadequate ventilation, power surges, voltage input excessive or incorrect, radiation, electrostatic discharges, including lightning, other forces and external impacts.

l) plasma or LCD panels that are in series, ISO13406-2 with the following numbers of pixels: No. 2 white or No. 2 or No. 5 dark sub-pixel color

9.7 The only obligation D2A Servizi srl under this warranty is to repair or replace products under these terms and conditions of warranty. D2A Servizi srl disclaims any responsibility for any loss or damage relating to this Guarantee or otherwise, including economic loss or intangible, the price paid for the product, loss of profits, revenue, data, enjoyment or use of this or any other associated losses or any indirect, incidental or consequential damages.

This goes for any loss or damage arising from:

  1. impairment of functioning or failure of the product or products associated with later defects or unavailability of spare parts during the stay at D2A or other authorized service center, resulting in downtime, loss of time or interruption;
  2. imperfect performance of the product or associated products;
  3. damage or loss of programs, files, software and/or removable data storage media, or viruses and other causes.

This applies to losses and damages under any legal theory, including negligence and other tort, breach of contract, express or implied warranty and strict liability (even if D2A or authorized service center have been informed the possibility of such damages).
Where applicable law prohibits or limits these liability exclusions, D2A Servizi srl excludes or limits its liability to the maximum permitted by applicable law. The responsibility for D2A Servizi srl under this guarantee shall not exceed in any case the price paid for the product, provided that where the applicable law imposes higher limits of liability will apply these limits.

9.8 Mode of service delivery:

* For any defect purchased the Consumer must send the request for assistance via the web site refer to the "Technical Support", or contact the Call Center number +39 02 42292871 (Italian and English only), Monday to Friday at the times shown on the site.

* Operators will be done by a Help Desk Level 1, then if it had not solved the problem, opening a request RMA (Return Merchandise Authorisation), communicating to you the case number assigned and instructions for 'completion of service under warranty.

* You will need to communicate the product's serial number and details of purchase document in order to identify the product and check the warranty.

* To avoid paying shipping costs and technical verification, the User is obliged to make sure of the defect and to report any other cosmetic damage of the product, otherwise the machine is broken or damaged accidentally, there would be those costs incurred.

10. - RIGHT OF RETURN

10.1 For distance contracts and contract negotiated away from business premises, Consumers shall be entitled to a period of ten (10) business days to withdraw from a contract without being liable to any penalty and without giving any reason, in accordance with the Directive no. 97/7/CE.
The right of return may be exercised by Consumer only, that is any natural person who is acting for purposes which are outside his trade, business or profession. No right of return is held by Companies.

10.2 The right of return may be exercised by the Consumer within 10 (ten) business days from receival of products (14 days for purchases with delivery in Germany), by sending a registered letter with acknowledgment of receipt, or by e-mail at info@arredatutto.it (alternatively, you can use the form at http://www.arredatutto.it/en/returns.html ) or by fax +39 02 92878721, where all bank data needed for refund must be indicated. Once received the Consumer's communication, D2A will reply via e-mail, specifying how to send the goods back.

10.3 The right of return is subject to the following mandatory conditions:
• The law applies to the whole purchased product, it is not possible to exercise return on parts of the product only (eg accessories, software, attachments, etc. ...);
• The purchased goods must be in perfect unused conditions, complete of all accessories and data sheets and returned in original packaging, complete in all its parts including packaging and any documentation and ancillary equipment: manuals, cables, etc; to limit damage to the original package, we recommend, when possible, to ship the goods into a second box;
• the property subject to right of return must be returned in perfect condition, preserved with the use of reasonable diligence: used products, or products that indicate signs of damage or dirt can not accepted back
postage for the return of the items are on the Consumer's charge
• shipment is under the full responsibility of the Client;
• if goods are damaged during transport, D2A Servizi will inform the Consumer (within 5 working days of receipt of the goods in their warehouse), to enable Consumer to file a timely complaint against the carrier of his choice and to obtain refund on item's value (if shipment was insured by the Consumer); in this case the damaged product will not be accepted as a return and it will be available to the Consumer for pick up;
• D2A Servizi can not respond in any way for damage or theft/loss of goods returned by uninsured shipments.

10.4 Without prejudice to repair costs for damages assessed to the original packaging (which for some products can reach up to 30% of product value, as this will be sold as "reconditioned"), D2A will refund to Consumer of the product's price (minus delivery costs) as quickly as possible and within 30 days of receival.

10.5 The right of return cannot be accorded, for lack of essential conditions like integrity of the item (the packaging and/or its content), where D2A finds:
• lack of outer and/or original inside components;
• absence of integral elements of the product (accessories, cables, manuals, parts, ...) or defect to the product itself;
• damage to the product;
• a state of dirt os scratches due to use of the product, which has compromised its integrity.
The costs and risks of transport for the return are charged on the Consumer.
The return of products that are damaged, deteriorated or deprived of accessories and original equipment will not be accepted by D2A and products will be available to the Consumers for pick up.


11. - NOTICES

Any communication or dispute, unless otherwise provided, shall be made by e-mail or by registered letter with acknowledgment of receipt or in case of urgency, by telegram or fax to the address of the Parties, or to contact those who may subsequently be indicated.


12.-PRIVACY

12.1 The personal information required during the placing of the order are collected and processed by D2A on media in order to satisfy the obligations under the contract concluded with the client. The data, or some of them, for the purposes previously specified may be disclosed to:

1) third parties that perform related functions in the performance of service, such as, but not limited to, the management system, assistance and advice on accounting, administrative, legal, tax and financial

2) those whose right to access the data is recognized by law or by order of the authorities.

D2A Servizi srl may also disclose information to third parties who request them for advertising purposes and/or co-marketing.

12.2 The Consumer, at any time, has the right to withdraw consent to the processing of personal data by written notice to be sent to the registered office of D2A Servizi srl

12.3 The Consumer, who claims to have received the information under Article. 13 and belonging to the same rights under Article. 7 D. lgs. No 196/2003, has the right to access their data in the manner specified therein. Marketing communications will be sent only with the explicit consent of the Consumer authorization issued together with the processing and sending the registration form online.

13. - LAW AND JURISDICTION

13.1 This contract of sale between the Client and D2A Servizi srl is regulated by Italian law.

13.2Any dispute arising from the interpretation or performance of this contract will be referred to the exclusive knowledge of the Forum in Milan.
